These Terms & Conditions (“Terms”) govern your access to and use of GiftHorse (“GiftHorse”, “we”, “us”, “our”) and the website https://gift-horse.online (the “Site”). By submitting a form, purchasing an e-voucher, or otherwise using the Site, you agree to these Terms and to our Privacy Policy.
1. DEFINITIONS AND INTERPRETATION
“offer” — the description on the Site of a specific experience/service (including price, inclusions/exclusions and key restrictions).

“e-voucher” / “voucher” — a digital gift voucher for a selected offer with an open date; it allows you to request a booking with a supplier; it is not e-money or stored value.

“supplier” — the third-party operator that delivers the experience.

“aggregator” — a partner that coordinates bookings with one or more suppliers.

“purchaser” — the person who buys a voucher.

“recipient” — the person who redeems/uses a voucher.

“booking” — a reservation request coordinated by us with a supplier (or via an aggregator).

“booking confirmation” — our written notice (email/WhatsApp) that a specific date/time has been secured.

“supplier rules” — the supplier’s (or aggregator’s) terms, policies and requirements that apply to performance of the experience.
“validity period” — the time during which a voucher can be redeemed, starting on purchase and ending on expiry.

“price” — the amount shown on the offer at purchase; only the inclusions expressly listed are covered.

“site” — https://gift-horse.online and related pages we operate for the offers.
2. OUR ROLE
2.1 We do not operate or perform the experiences. Each experience is delivered by the relevant supplier (directly or via an aggregator).

2.2 We act as an agent for the sale of e-vouchers and for coordinating bookings with suppliers/aggregators.

2.3 Supplier rules (including eligibility, safety, cancellation/no-show and weather/operational policies) govern the performance of the experience. These Terms govern the sale of vouchers and our coordination role.

2.4 Descriptions, images and itineraries on the Site may originate from suppliers and may change due to safety, weather or operational reasons. Availability for specific dates/times is not guaranteed until a booking confirmation is issued.

2.5 Except where expressly stated otherwise, we are not a party to the contract for performance of the experience, which exists between you (purchaser/recipient) and the supplier.
2.6 Where bookings or voucher redemptions are coordinated through an aggregator, you acknowledge that the aggregator acts as the intermediary responsible for coordinating and managing the experience on behalf of participating suppliers. In such cases, GiftHorse acts solely as a facilitator and is not a party to the contract for the performance of the experience. Any refunds, cancellations, changes or claims related to the experience shall be handled directly by the aggregator in accordance with their applicable terms and policies. We will provide you with the aggregator’s contact and policy details upon request.
3. ORDERS, PRICE & PAYMENT
3.1 Enquiries & offers. You may submit an enquiry on the Site. If you proceed, we will issue a secure payment link (e.g., Stripe). A contract for the e-voucher forms upon successful payment.
3.2 Price. The price shown on the offer covers only the inclusions expressly listed. Any taxes & fees, upgrades, add-ons or local surcharges required by the supplier are not included unless stated.
3.3 Currency & FX. Prices are shown in AED. If your card operates in a different currency, your bank/card network may apply FX rates and fees.
3.4 Payment processing. Payments are processed by the payment processor (currently Stripe). We do not store full card details. Transaction confirmations we receive (status, amount, time, last4) are used to issue the voucher and manage bookings.
3.5 Anti-fraud & chargebacks. We may refuse, suspend or cancel an order/voucher if fraud or chargeback risk is suspected. If a payment is charged back, we may cancel the voucher/booking and refuse service unless and until the amount is re-paid.
3.6 Errors. If a manifest pricing or content error occurs, we may cancel the order and refund you, or offer you the option to proceed at the correct price/content.
3.7 Contact channels. Operational communications (payment links, voucher delivery, booking details) may be sent via email and/or WhatsApp. By choosing WhatsApp, you acknowledge processing by WhatsApp/Meta under their terms.
4. ISSUE OF E-VOUCHERS; NATURE OF VOUCHERS
4.1 After successful payment we issue an e-voucher with a unique number and basic instructions, delivered by email and/or WhatsApp.

4.2 An e-voucher grants the right to request a booking for the selected offer subject to supplier rules and availability. It is not e-money, a stored-value instrument or a general-purpose gift card.

4.3 Vouchers have no cash value, are non-redeemable for cash, and may not be used for other products/services unless expressly stated.
5. VALIDITY, TRANSFER & EXPIRY
5.1 Validity period. Unless stated otherwise on the offer page, the validity period is 12 months from purchase.

5.2 Expiry. Unredeemed vouchers automatically expire at the end of the validity period; the amount is not refundable.

5.3 Transfer. Vouchers are personalised. Name changes before booking may be permitted on request; resale is prohibited.

5.4 Loss/theft. Treat your voucher like a ticket. If lost or compromised, contact us; replacement may be possible if the voucher has not been redeemed.
6. REDEMPTION & BOOKING PROCESS
6.1 How to redeem. The recipient (or purchaser) contacts us via email/WhatsApp, provides the voucher number and 2–3 preferred dates/times, and any information required by the supplier (e.g., participant count).

6.2 Coordination. We liaise with the supplier (or aggregator) to secure a slot and send a booking confirmation (meeting point, time, contacts, rules).

6.3 Availability. Availability for specific dates/times is not guaranteed until booking confirmation is issued. Seasonal capacity and supplier policies apply.

6.4 On-site rules. The supplier may require ID checks, waivers, dress code, arrival times and compliance with eligibility/safety requirements.

6.5 Post-confirmation. Once confirmed, section 7 (changes/cancellations/refunds) applies.
7. CHANGES, CANCELLATIONS & REFUNDS
7.1 Before booking confirmation.

(a) All voucher sales are final and non-refundable.
(b) If the selected experience is unavailable within a reasonable timeframe despite our commercially reasonable efforts, or if you wish to change your choice before a booking is made, we may—at our discretion—offer a one-time exchange of the voucher for another available experience of equal or lower value (price difference, if any, is not refundable).
7.2 Once a voucher has been redeemed and a booking confirmed, no cancellations or refunds are possible. A date change may be possible only if allowed by the supplier rules and subject to slot availability and any applicable fees.
7.3 No-show / late / ineligibility. Failure to attend on time, satisfy eligibility (age/health/documents) or comply with supplier rules is treated as used; no refund or exchange applies.
7.4 Weather / operational issues / force majeure. Managed under the supplier rules (typically re-schedule or credit). We will assist with coordination.
7.5 If a payment is charged back or suspected fraudulent, we may suspend or cancel the voucher/booking and refuse service unless and until resolved.
8. ELIGIBILITY & SAFETY
8.1 Supplier rules. Eligibility, safety and conduct requirements are set by the supplier rules (and any aggregator policies) and apply to the performance of the experience.
8.2 Age, health, documents. Certain experiences require minimum age, fitness/health declarations, weight/height limits, valid ID, licences or waivers. You are responsible for meeting these requirements.
8.3 Behaviour. Suppliers may refuse service for intoxication, abusive/unsafe behaviour, breach of instructions, late arrival or missing equipment. Such cases are treated as used; no refund.
8.4 Equipment & damage. You are responsible for loss/damage you cause to equipment or property, as determined under supplier rules and applicable law.
8.5 Minors. Where minors participate, bookings must be made and supervised by a parent/guardian. Additional restrictions may apply under supplier rules.
9. COMMUNICATIONS
9.1 Operational messages. We send operational communications (payment links, voucher delivery, booking confirmations/updates) by email and/or WhatsApp using our published contact channels.
9.2 WhatsApp. By choosing WhatsApp you acknowledge processing by WhatsApp/Meta under their terms.
9.3 Marketing. We send marketing messages only if you opt in; you can opt out at any time.
9.4 Accuracy & delivery. You must keep your contact details accurate and whitelist our addresses. Messages sent to your provided details are deemed received when sent (save for manifest error).
10. FRAUD, MISUSE & SECURITY
10.1 Refusal/suspension. We may refuse, suspend or cancel any order, voucher or booking if we reasonably suspect fraud, abuse, resale, violation of these Terms or applicable law, or to protect customers/suppliers.

10.2 Chargebacks. If a payment is charged back, we may cancel the voucher/booking and refuse service unless and until the amount is re-paid or the chargeback is reversed.

10.3 Security checks. We may perform reasonable verification (e.g., email/phone validation, duplicate checks) before issuing a voucher or confirming a booking.

10.4 Prohibited uses. You must not scrape, interfere with, or misuse the Site, nor purchase vouchers for resale or in violation of export, sanctions or consumer laws.
11. WARRANTIES & DISCLAIMERS
11.1 As is. Except as expressly stated, the Site and vouchers are provided “as is” and “as available.”

11.2 Availability & changes. We do not guarantee availability for any specific date/time. Suppliers may modify itineraries, content or timing for safety, weather or operational reasons.

11.3 Third-party content. Descriptions, images and rules are provided by or based on information from suppliers/aggregators and may be illustrative.

11.4 No implied warranties. To the maximum extent permitted by law, all implied warranties (merchantability, fitness for a particular purpose, non-infringement) are excluded.
12. LIABILITY
12.1 Supplier responsibility. The supplier provides and is responsible for the performance, safety and quality of the experience. We will assist with escalation but are not responsible for supplier acts/omissions.

12.2 Cap. To the maximum extent permitted by law, our aggregate liability for any claim arising from or in connection with a voucher is limited to the amount paid for that voucher.

12.3 Exclusions. We are not liable for indirect, incidental, special, consequential or punitive losses; lost profits/revenue; loss of enjoyment; or loss/corruption of data.

12.4 Non-excludable liability. Nothing in these Terms limits liability that cannot be limited by law (e.g., death or personal injury caused by negligence, fraud). Your mandatory consumer rights are not affected.

12.5 Force majeure. Neither party is liable for delay or failure caused by a force majeure event. If such an event materially affects an experience, the supplier rules (e.g., re-schedule/credit) apply; we will help coordinate.
13. INTELLECTUAL PROPERTY
13.1 The Site (text, graphics, logos, images, layout and code) and the GiftHorse name/marks are owned by us or our licensors.

13.2 You may use the Site and its content for personal, non-commercial purposes to browse offers and purchase/redeem vouchers. Any copying, scraping, framing, reverse engineering or derivative use is prohibited without our prior written consent.
14. PERSONAL DATA
Your personal data is processed in accordance with our Privacy Policy. For booking, we share only the minimum necessary data with suppliers/aggregators. By using WhatsApp, you acknowledge processing by WhatsApp/Meta under their terms.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last updated” date at the top shows the latest revision. Material changes will be highlighted on this page.
16. MISCELLANEOUS
16.1 Entire agreement. These Terms (together with the Privacy Policy and the offer page) constitute the entire agreement between you and us regarding vouchers and coordination services.

16.2 Severability. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force.

16.3 Assignment. You may not assign or transfer your rights or obligations without our prior written consent. We may assign these Terms to an affiliate or in connection with a corporate transaction.

16.4 No waiver. A failure or delay to enforce a right is not a waiver of that right.

16.5 Notices. We may provide notices by email or WhatsApp to the contacts you supply.

16.6 Language. If these Terms are translated, the English version prevails to the extent of any inconsistency.
